Terms of Service

These plain-English terms cover using XAM. For a contract tailored to an institution, or the definitive governing terms, contact privacy@xam.pro.

Accepting these terms

By creating an account or using XAM, you agree to these terms. If you are using XAM on behalf of an institution, you confirm you are authorised to accept these terms for it.

The service

XAM generates, delivers and grades assessments from material you upload. We improve the product over time, so features may change. Features described as “coming soon” are planned, not guaranteed by a particular date.

Your account

You are responsible for your account and for keeping your credentials secure. You must provide accurate information and be authorised to upload the material you upload.

Your content and ownership

You keep ownership of everything you upload and everything you generate in XAM. We claim no ownership over your content. You grant us only the permission we need to provide the service: to process your files in order to generate questions, and to store your content in your account.

We never use your content to train AI models. See our Privacy Policy for the full commitment.

Acceptable use

When using XAM, you agree not to:

  • Upload content you do not have the rights to use.
  • Use the service unlawfully, or to infringe anyone's rights.
  • Attempt to breach or probe the security of the service.
  • Interfere with the service or its availability for others.

You are responsible for the assessments you create and for how you use them. XAM proposes questions; you review and approve them before use.

Plans, credits and billing

XAM offers a Free plan and paid plans. Generation is measured in credits, as described on the Pricing page. Paid plans are billed monthly or annually and can be cancelled at any time, reverting to the Free plan at the end of the billing period. Top-up credits never expire. Your question bank is preserved regardless of plan changes.

Availability

We work to keep XAM reliable and available, but we do not guarantee that the service will be uninterrupted or error-free.

Disclaimers and your responsibility

XAM is a tool that assists you; it does not replace your professional judgement. Every generated question is shown to you for review, and you decide what to keep, edit or discard. You are responsible for checking the accuracy and suitability of any assessment before you use it. The service is provided on an “as is” basis.

Limitation of liability

To the extent permitted by applicable law, XAM is not liable for indirect or consequential loss arising from your use of the service, or from assessments you create and deliver with it. Nothing in these terms limits any liability that cannot be limited by law.

Termination

You can close your account at any time from Account Settings; export your question bank first if you want to keep it. We may suspend or close an account that breaches these terms. On closure, associated data is deleted as described in our Privacy Policy.

Governing law

These terms are governed by the law applicable where XAM operates. For the specific governing jurisdiction, or for an agreement tailored to your institution, contact privacy@xam.pro.

Changes to these terms

We may update these terms as the service evolves. We will update the date above, and continued use after a change means you accept the updated terms.
